Auction Terms & Conditions 1. THE TERMS AND CONDITIONS GIVEN ARE A BINDING CONTRACT. By registering to bid live and/or on the Internet, you agree to abide by all terms and conditions, and you acknowledge receipt of all explanations and information made available by Hiatt Auction LLC. **OUT OF AREA BIDDERS PLEASE READ TERMS AND CONDITIONS REGARDING PAYMENT AND SHIPPING. 2. ONLINE PURCHASE All local successful purchases under $2000 will pay at pick up with cash, MasterCard, Visa or Discover. Out of area bidders and purchases totaling over $ 2000 must pay with a bank wire transfer or ACH transfer. due by 1:00 PM CDT the business day after the sale closes. 3. BUYER'S PREMIUM A 10% buyer's premium will be added to all winning bids, resulting in the total purchase price. Your Internet bids are a contract, and you are required to honor them. 4. SALES TAX / USE TAX State law requires Hiatt Auction LLC to collect sales tax on all transactions. If your purchase qualifies for tax exemption you will be required to fill out the Kansas State form prior to bidding. Bidders must advise of exemption status and fill out KANSAS REQUIRED tax form at registration. Please contact us if you need assistance. 5. BID AND BIDDER QUALIFICATION PROCESS. All bidders must register with form of payment (credit or debit card) being used. INFORMATION ON CARD MUST MATCH BIDDER INFORMATION. Bidders with prior history of nonpayment at auctions will be excluded from bidding. INTERNET BIDDING This is an Internet-only auction, which means the highest bid online when the bidding closes on an item will be the winning bid for that item. Bidding for items will begin to close every 20 seconds. The items will close in the order listed on the website. This auction will feature our automatic extension system which will grant a (3) minute extension to the end of the auction of any item receiving a bid during the last three (3) minutes. The item will then close when three (3) minutes have elapsed without any bidding activity. All items are selling without reserve, and all Internet bids are treated as if they were given at a live auction. All bidders will be held accountable for their Internet bids. There are no bid retractions. Hiatt Auction reserves the right to cancel any Internet bid if the bidder refuses or fails to timely cooperate with the auction company's efforts to verify the bidder's qualification to bid. Unless we stated on the lot "Tested Works" the item may not have been tested. We strongly encourage buyers to preview items or to contact us for more information prior to bidding. Buyers assume all risks at the conclusion of the auction. All sales are final. No refunds given. Credit card transactions may not be reversed. Although mostly intact there are items that are used and might have pieces missing of which we are not aware. Listings include written descriptions, photographs. Equipment descriptions are based on our direct observation and information provided by the consignor. All information is intended to be as accurate as possible. Again-we recommend customers inspect prior to bidding. Information given regarding the items listed are not intended to be substitutions for inspection. An error or omission in the listing will not change the results of the bid. INVOICING AND PAYMENT INFORMATION Invoices will be emailed to winning bidders at the conclusion of the auction with the exceptions listed: Any invoice totals over $2,000 and for out of area buyers will need to be paid via wire or ACH funds transfer to our financial institution. It is a straightforward process which must be done no later than 3PM CDT the next business day after the sale. PLEASE plan with your financial institution prior to bidding. We will email wire instructions at the end of the sale. All local invoice totals under $2,000: payment will be required at pickup. Forms of payment accepted: MasterCard, Visa, and Discover are accepted only for charges up to $2,000, and only after authorization in-person signatures are obtained from the cardholder. Unsuccessful credit card transactions will result in immediate payment due. Please contact us prior to the sale if you would prefer a wire transfer to our bank. Please verify with your bank or credit card company if you need to raise your card limit prior to bidding. Failure to pay by the payment deadline noted in these terms and conditions will result in an additional administrative fee equal to 10% of the winning bid price (minimum $20.00 fee) per invoice. Shipments 50# or less will be shipped USPS unless a Fed Ex or a UPS tag is provided by the buyer. Parcel prep fee is $20 per 50#. Any items over 50# must be shipped with a freight carrier. Charges for freight prep $50 per pallet. If shipping or having an agent pick up items purchase payment must be made by wire transfer. All shipping arrangements must be made by email. After the removal deadline, Hiatt Auction LLC may also declare the asset abandoned resulting in additional costs and potential losses to the buyer. Under $2,000 local buyers: MasterCard, Visa, Discover, Cash. Over $ 2,000 and out of area buyers: Wire transfer, ACH funds transfer to be paid by 3PM CST the next business day (Friday). We will contact you and send bank wire instructions. No checks. Auction invoices are available once the complete auction has closed. Please contact us prior to the sale if you would prefer a wire transfer to our bank. As stated, nvoice totals over $2,000 will need to be paid via wire to our financial institution. It is a simple process which must be done no later than 3PM the next business day after the sale. Please contact your financial institution prior to the sale for any questions regarding this. Failure to make payment or payment arrangements by 3:00 PM CDT may result in a $30 late payment fee. Hiatt Auction reserves the right to charge the credit card on file the total purchase price and a $30 late payment fee will be added for invoices not paid within our terms. Local pickups take precedence. PARCEL SHIPMENTS: We ship items weighing 50 # or less USPS Priority. We charge $20 per shipment for prep and transport up to 50 pounds. Items packaged at auction company's discretion. No aerosol or flammable items will be shipped. If you provide a label for UPS or Fed Ex., we will be happy to assist with that. After shipment is made, we will charge your credit card on file for our prep fee and what ever the postal service charges for priority shipping and insurance. PLEASE let us know what value you want placed on the items. FREIGHT SHIPMENTS: Prep fee $50 per pallet. We can advise the number of pallets, estimated weights and dimensions for your shipment. You can obtain reasonable quotes through freightquote.com. Please note if you choose a carrier you prefer outside of our recommended group any missed pick-ups will incur rescheduling fees.
